Summary:

If you do not have the means, or for other reasons, do not wish to utilize a Revocable Living Trust for your estate plan, it is still important to implement a plan to ensure your life’s work is distributed to those you wish to inherit your belongings. This is even more important for non-married individuals with no children, as the default rules could likely result in random family members receiving a portion of your estate under fairly simple circumstances. Thus, although a will is not as useful and practicable as a Revocable Living Trust, it is the bare minimum estate planning vehicle an individual should employ. 

Essentially, the largest difference between a Will and a Revocable Living Trust is that a Revocable Living Trust saves your heirs and beneficiaries time and money. This is because a court’s probate process (i.e. the legal channel that determines what your assets, liabilities are, and who will end up inheriting your estate) can take months, and occasionally over a year) to resolve, and that process can also result in high costs and fees (ranging from thousands to tens of thousands of dollars).  A Revocable Living Trusts counteracts these issues as it is a vehicle used to bypass the probate process. 

What’s Included:

This purchase provides you (and your partner/spouse) with a will that will distribute all of your assets to the other (then living) spouse in the event that you or your partner/spouse dies. If both you and your partner/spouse become deceased within 30 days of each other, then your kids will inherit your property in equal shares (unless you choose otherwise).
